What does Subpoena mean?
A subpoena is a request for an individual to appear in court for a legal proceeding or the request for information to support facts in a pending criminal case. Common documents or information which can be requested include blood information, DNA samples, computer files, medical bills, income tax returns, and photographs. Subpoena literally means under penalty. Individuals who receive a subpoena and fail to follow its terms can face criminal and civil penalties.
A subpoena is generally requested by a lawyer and is served to an individual generally in person or through certified mail. If you receive a subpoena you should not ignore it. Failing to respond is considered a contempt of court charge. You may also wish to consult with a lawyer to discuss information or testimony you may be required to give at court. If you believe the subpoena is asking you to appear in court and produce testimony which may violate your Fifth Amendment Constitutional rights not to incriminate yourself you should talk to a criminal lawyer.
A subpoena will include the name and address of the court where the case has been filed, the case number, a statement explaining what you are required to do, when you need to appear in court or where you need to come to give a deposition.
