Sole Legal Custody

What does Sole Legal Custody mean?

Sole legal custody is a child custody agreement which allows one parent to have the legal authority to make decisions for a child. Common decisions which are made under this agreement include decisions about religion, health care, and education. Legal custody is different than physical custody. It is possible for parents to share legal custody while one parent has sole physical custody.

Courts generally allow for shared legal custody but there are some benefits of sole legal custody. For instance, sole legal custody may provide consistency for the child and may allow for decisions to be made more quickly. If one parent is unavailable or not involved in the child's life sole legal custody may be necessary for decision making.
