What does Mediation mean?

Mediation is one of the most common types of alternative dispute resolution techniques. It allows for a third party mediator to help resolve the conflict between two people and avoid taking the case to court. Mediation is confidential, informal and voluntary. The decision in mediation is generally not binding.

Mediators, who are trained negotiators, listen to the issues at hand, and if possible, they provide a fair solution. The mediator is a neutral third party. They do not decide who wins or loses but they simply listen to each person's side of the story, identify issues each party may not have considered, help each person discuss their concerns and offer a viable solution.

Mediation is frequently used in divorce cases and can save cost and time over going to trial. Some conflicts will require each party to attempt mediation prior to trial.
