Loss of Consortium

What does Loss of Consortium mean?

In a personal injury claim a spouse may be allowed to recover compensation for damages from loss of consortium if a spouse is killed or injured due to the negligence of another person. Loss of consortium is not simply sexual relations but can include any loss of affection, love, emotional support, companionship and benefits the injured spouse provided for household chores and child care services. In short, it can include compensation for any type of spousal function which has been lost due to the injury or death.

If you have lost your spouse or your spouse has been seriously injured, talk to a personal injury lawyer. Because loss of consortium is not an objective financial amount you may need help calculating the cost of the precise monetary loss or objective cash value. Consider also, a valid marriage is a prerequisite for a claim for loss of consortium, and the amount awarded is left to the discretion of the judge or jury.
