What does Applicants Attorney mean?

Workers injured while performing their normal job duties are generally entitled to workers' compensation benefits. Many workers can file their workers' compensation claim directly with their employers and will receive immediate benefits without legal assistance. An applicant attorney is available, however, to help any injured worker who needs legal help with their workers' compensation claim.

When would I need an applicant's attorney?

For minor cuts, sprains, or injuries which do not require surgery it is generally safe for an injured worker to deal directly with their employer and avoid hiring a work comp lawyer or applicant attorney. There are, however, very specific times when you need to talk to an applicant's attorney:

  • You have a serious injury which requires surgery.
  • Your injury may inhibit your ability to return to your previous employment.
  • Your injury will prevent you from returning to any type of work.
  • You have pre-existing disabilities.
  • Your claim is denied by the Workers' Comp Insurance Company or your employer tells you your injury is not covered.
  • You did not receive all of your benefits.
  • Your doctor says you are able to return to work but you disagree.
  • You believe you may need more medical treatment for your injury in the future.
  • You are currently receiving Social Security Disability benefits.
  • You will become eligible for Medicare within 30 months of your work injury.
  • You were fired due to your work injury.
  • Your injury was caused by the negligence of another person in your company.
  • You do not have the expertise to negotiate a fair settlement with workers' compensation.
  • You have unpaid medical bills from your workers' compensation claim
